CHN.725/90. This permission was subject to a planning condition (no. 2) which indicated that the use should be discontinued within 5 years whilst planning condition no. 3 required the mobile home building to be removed within a period of 5 years and the site restored to its former condition. This 5-year period expired on 19th November 1995. This mobile home building has been used, occupied and in-situ continuously now for almost 29 years in breach of planning condition nos. 2 & 3 of the permission no. CHN.725/90. As there is clear evidence to show that the mobile home has been on site and used for over 10 years the building is therefore lawful under Section 171B of the Town & Country Planning Act, 1990 (as amended)
